When you use this Site, you acknowledge your acceptance of these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use the Site.

By providing your telephone number and affirmatively opting in to receive mobile communications, you provide express written consent to receive marketing and informational messages from RideJetson (including its affiliates, agents, and service providers) via SMS, MMS, text message, or other electronic means to the telephone number you provide. Such messages may include promotional offers, order updates, and other information about our products and services.

You understand that:

•       Your consent is not a condition of purchasing any goods or services from RideJetson.

•       Message and data rates may apply.

•       Message frequency may vary.

•       You may opt out at any time by texting STOP to any message from us. After texting STOP, you will receive a single confirmation message and no further marketing messages will be sent.

RideJetson’s mobile messaging service is provided “as is” and “as available.” RideJetson is not liable for any delays in the receipt of messages, any actions taken in reliance on a message, or any damage to your device arising from participation in the mobile alerts program.

Note: Text messaging originator opt-in data and consent will not be shared with any third parties.

2. Products, Content and Specifications

All features, content, specifications, products, and prices described or depicted on the Site are subject to change at any time without notice. We make reasonable efforts to accurately display product attributes, including sizes, designs, and colors; however, actual colors may vary depending on your device’s display settings, and we cannot guarantee color accuracy.

The inclusion of any product or service on the Site at a particular price does not guarantee availability at that price. It is your responsibility to comply with all applicable local, state, federal, and international laws — including minimum age requirements — regarding the possession, use, and sale of any item purchased from the Site. By placing an order, you represent that the products ordered will be used only in a lawful manner.

3. Orders and Price

The information on this Site does not constitute a binding offer to sell products described on the Site. We reserve the right, at any time after receipt of your order, to accept or decline your order or any portion thereof in our sole discretion, even after you receive an order confirmation or after your payment method has been charged. Prices displayed on the Site are quoted in U.S. dollars and are valid only within the United States.

In the event a product is listed at an incorrect price, we reserve the right to refuse or cancel any orders placed at the incorrect price, regardless of whether the order has been confirmed or your payment has been processed. If your payment has already been charged and your order is cancelled, we will issue a full refund to your original payment method.

4. Shipping Limitations

When an order is placed, it will be shipped to the address designated by the purchaser, provided that address complies with the shipping restrictions described on the Site. All purchases are made pursuant to a shipment contract. Risk of loss and title for items purchased pass to you upon delivery to the carrier. You are responsible for filing any claims with carriers for damaged or lost shipments.

5. Promotions and Availability

All promotions offered by RideJetson apply to purchases shipped within the United States unless otherwise noted. RideJetson offers services and products in various parts of the world. References to services or products on the Site do not imply that those services or products are available in all locations.

6. Limited Warranty Policy Statement

When you register your Product with RideJetson at https://ridejetson.com/pages/product-registration within 30 days of purchase, you will be eligible for warranty service under the terms of our Limited Warranty. Please review the full warranty terms available on our Site.

This Warranty does not apply if the Product:

•       Has been used commercially or for non-household or rental applications

•       Was purchased from an unauthorized seller

•       Has sustained cosmetic changes that do not affect performance

•       Has been damaged due to misuse, abuse, negligence, accident, or unauthorized modification

7. Accuracy of Information

We attempt to ensure that information on the Site is complete, accurate, and current. Despite our efforts, information may occasionally be inaccurate, incomplete, or out of date. We make no representation that all information on the Site is accurate, complete, or current at all times. Products may be unavailable, may have different attributes than listed, or may carry a different price than stated. We reserve the right to limit order quantities, refuse service, or require verification of information prior to accepting or shipping any order. Receipt of an email order confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell.

8. Use of the Site

The design of the Site and all text, graphics, information, content, and other material displayed on or available for download from the Site are owned or licensed by RideJetson and are protected by copyright, trademark, and other applicable laws. You may not modify, reproduce, publicly display, distribute, or otherwise use any such materials for any public or commercial purpose without prior written permission. Unauthorized use may violate copyright, trademark, privacy, and other laws.

You are prohibited from:

•       Accessing content or data not intended for you, or logging onto a server or account that you are not authorized to access

•       Attempting to probe, scan, or test the vulnerability of the Site, or any associated system or network, or to breach security or authentication measures without proper authorization

•       Interfering or attempting to interfere with service to any user, host, or network, including by submitting a virus, overloading, flooding, spamming, mail bombing, crashing, or instituting a DDoS attack on the Site

•       Using the Site to send unsolicited e-mail, including promotions or advertisements for products or services

•       Forging any TCP/IP packet header or any part of the header information in any e-mail or posting using the Site

•       Attempting to modify, reverse-engineer, decompile, disassemble, or otherwise reduce any source code used by us in providing the Site

 

Any violation of system or network security may subject you to civil and/or criminal liability.

Certain trademarks, trade names, service marks, and logos used or displayed on the Site are registered and unregistered marks of RideJetson and its affiliates. Other marks belong to their respective owners. Nothing on the Site grants, by implication, estoppel, or otherwise, any license or right to use any mark displayed on the Site without the prior written permission of RideJetson or the applicable owner.

10. Linking to the Site

Creating or maintaining any link from another website to any page on this Site without our prior written permission is prohibited. Displaying the Site or any of its content within frames or through similar means on another website without our prior written permission is also prohibited. Any permitted links must comply with all applicable laws and regulations.

11. Third-Party Links

The Site may contain links to third-party websites not owned, operated, or controlled by RideJetson or its affiliates. Such links are provided solely as a convenience. We are not responsible for any content, materials, or other information located on or accessible from any third-party website, and we do not endorse or make any representations about them. If you access any third-party website linked from the Site, you do so entirely at your own risk.

12. Inappropriate Material

You are prohibited from posting or transmitting any unlawful, threatening, defamatory, libelous, obscene, pornographic, or profane material, or any material that could constitute or encourage criminal conduct or civil liability. We reserve the right, in our sole discretion, to remove any such material from the Site and to take appropriate legal action. We will cooperate with law enforcement authorities or comply with court orders directing us to disclose the identity of anyone posting such material.

13. User Communications

Any material, information, suggestions, ideas, concepts, know-how, techniques, questions, comments, or other communications you transmit or post to the Site (“User Communications”) will be considered non-confidential and non-proprietary. By submitting User Communications, you grant RideJetson a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and create derivative works from such content for any purpose and in any media.

We may, but are not obligated to, monitor or review User Communications. We will have no liability related to the content of any User Communications. We retain the right to remove any User Communications that we deem inappropriate or unacceptable in our sole discretion.

14. Unsolicited Product Ideas

RideJetson does not solicit ideas for new products or advertising from third parties. If you submit an unsolicited product idea, you waive any right to compensation for that idea, and the submission becomes the exclusive property of RideJetson. You are solely responsible for the content of your submission, including its reliability, originality, and copyright.

15. Software

RideJetson may make certain software available to you from the Site. If you download software from the Site, the software, including all files and images contained in or generated by the software, and accompanying data (collectively, “Software”) are deemed to be licensed to you by RideJetson for your personal, noncommercial, home use only. RideJetson does not transfer either the title or the intellectual property rights to the Software, and RideJetson retains full and complete title to the Software as well as all intellectual property rights therein. You may not sell, redistribute, or reproduce the Software, nor may you decompile, reverse-engineer, disassemble, or otherwise convert the Software to a human-perceivable form. All trademarks and logos are owned by RideJetson or its licensors and you may not copy or use them in any manner.

16. Disclaimers

YOUR USE OF THE SITE IS AT YOUR SOLE RISK. THE INFORMATION, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. RIDEJETSON DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION, MATERIALS, OR SERVICES ON THE SITE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RIDEJETSON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES WITH RESPECT TO PRODUCTS AND SERVICES LISTED OR PURCHASED ON OR THROUGH THE SITE. WE EXPRESSLY DISCLAIM ALL LIABILITY FOR PRODUCT DEFECT OR FAILURE, CLAIMS DUE TO NORMAL WEAR, MISUSE, ABUSE, PRODUCT MODIFICATION, IMPROPER PRODUCT SELECTION, NON-COMPLIANCE WITH ANY CODES, OR MISAPPROPRIATION. 17. Limitations of Liability

RIDEJETSON ASSUMES NO RESPONSIBILITY AND WILL NOT BE LIABLE FOR ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT, YOUR COMPUTER, TELECOMMUNICATIONS EQUIPMENT, OR OTHER PROPERTY ARISING FROM YOUR ACCESS TO, USE OF, OR BROWSING OF THE SITE, OR YOUR DOWNLOADING OF ANY INFORMATION OR MATERIALS FROM THE SITE.

IN NO EVENT WILL RIDEJETSON OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AFFILIATES, SUBSIDIARIES, AGENTS, SUCCESSORS, OR ASSIGNS — NOR ANY PARTY INVOLVED IN THE CREATION, PRODUCTION, OR TRANSMISSION OF THE SITE — BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OF, INABILITY TO USE, OR RESULTS OF USE OF THE SITE OR ANY LINKED SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN THE EVENT OF ANY PROBLEM WITH THE SITE OR ITS CONTENT, YOUR SOLE REMEDY IS TO CEASE USING THE SITE. IN THE EVENT OF ANY PROBLEM WITH PRODUCTS OR SERVICES PURCHASED THROUGH THE SITE, YOUR SOLE REMEDY IS FROM THE MANUFACTURER OR SUPPLIER IN ACCORDANCE WITH THEIR WARRANTY, OR TO SEEK A RETURN AND REFUND IN ACCORDANCE WITH OUR RETURNS POLICY.

18. Indemnification

You agree to indemnify, defend, and hold harmless TruRide Tech LLC, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third-party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your access to or use of the Site, your violation of these Terms of Use, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. We will notify you promptly of any such claim, loss, liability, or demand, and will provide you with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.

20. Informal Dispute Resolution

Before initiating arbitration or any legal proceeding, the party seeking to resolve a dispute must first provide written notice to the other party describing the nature of the dispute and the relief sought (“Notice of Dispute”). The parties agree to negotiate in good faith for a period of 60 days following receipt of the Notice of Dispute in an effort to resolve the matter informally. If the dispute is not resolved within that period, either party may proceed to arbitration as described in Section 21 below.

21. Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS AND GOVERNS HOW YOU AND RIDEJETSON CAN BRING CLAIMS AGAINST EACH OTHER. THIS SECTION WILL, WITH LIMITED EXCEPTION, REQUIRE YOU AND RIDEJETSON TO SUBMIT CLAIMS TO BINDING AND FINAL ARBITRATION ON AN INDIVIDUAL BASIS. YOU WILL NOT BE ABLE TO BRING A CLASS, COLLECTIVE, OR REPRESENTATIVE LAWSUIT CONCERNING ANY DISPUTE COVERED BY THIS ARBITRATION AGREEMENT.

You and RideJetson mutually agree to resolve any disputes between you and RideJetson, its related and affiliated companies, and/or any current or former employee, officer, or director of RideJetson or any related or affiliated company arising from your use of the Site and these Terms through binding arbitration rather than in court. You and RideJetson agree that this Arbitration and Class Action Waiver is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and will survive termination of these Terms.

Initiating Arbitration

To initiate arbitration, the party seeking to pursue a legal dispute must prepare a written demand setting forth the claim(s) and deliver it within the applicable statute of limitations period by hand or first-class mail to the representatives of the other party.

Arbitration shall be administered by the American Arbitration Association (“AAA”) before a single arbitrator mutually agreed upon by the parties. If the parties cannot agree within 30 days after arbitrator names have been proposed, the AAA will select a single arbitrator. If you are an individual, the AAA Consumer Arbitration Rules in effect at the time of filing will apply: https://www.adr.org/consumer.

Class Action Waiver

Except as otherwise required by applicable law, you and RideJetson agree to arbitrate disputes only on an individual basis. You waive any right to bring, participate in, or receive relief from any class, collective, or representative proceeding. No arbitrator may: (a) combine more than one individual’s claims into a single case without consent of all parties; (b) order or facilitate production of class-wide contact information or notification of others of potential claims; or (c) arbitrate any form of class, collective, or representative proceeding.

22. Choice of Law; Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the State of Texas, without regard to conflicts of law principles. Any action seeking legal or equitable relief arising out of or relating to the Site or these Terms that is not subject to arbitration will be brought exclusively in the federal or state courts located in Texas. A printed version of these Terms will be admissible in judicial and administrative proceedings to the same extent as other business documents originally maintained in printed form.

23. Revisions to These Terms

These Terms may be revised at any time. We will post the updated Terms on the Site with a revised effective date. Terms are subject to change without notice. You should review this page periodically. Certain provisions of these Terms may be superseded by legal notices or terms located on specific pages of the Site.

24. Termination

You or we may suspend or terminate your account or your use of the Site at any time, for any reason or no reason. You are personally liable for any orders placed or charges incurred through your account prior to termination.
