Jetson Social Media Sweepstakes Terms & Conditions

These terms govern how claims between you and Jetson Electric Bikes, LLC (“Jetson”) relating to your participation in the Jetson Social Media Sweepstakes will be addressed.
Jetson Social Media Sweepstakes Terms & Conditions
Entry to Jetson’s Social Media Sweepstakes is available only to persons over the age of 18 residing in the U.S. or Canada, except for employees of Jetson, and members of their immediate family or persons living in the same household. By entering the Sweepstakes, each entrant unreservedly agrees to these terms and conditions which govern the Sweepstakes and the awarding of the Prize(s). Void where prohibited.
Jetson Social Media Sweepstakes: To enter, entrants must follow the Jetson username @RideJetson on Instagram. Qualified users will be those that start following @RideJetson from October 10, 2022 10:00:00AM EST to October 31, 2022 5:00:00PM EST. On or about November 11, 2022, Jetson will select one (1) winner to win a Jetson Haze Electric Bike (Retail Value: $899.99). The winner will be chosen at random. Odds of winning depend on the number of entrants. Jetson shall notify the winner via Instagram Direct Message at the username that has followed @RideJetson. Prize will be delivered within 30 days after the completion of the Sweepstakes via UPS at Jetson’s expense. No substitution or transfer of prize permitted by winner.
No purchase or payment of any kind is necessary to enter or win. A purchase or payment will not increase the chances of winning.
Use of any robotic, automatic, programmed, or similar entry method will void all entries and result in disqualification.
Jetson is not responsible and will have no obligation or liability resulting from: (i) a participant’s entry or attempt to participate in the sweepstakes, (ii) incorrect or incomplete information, whether caused by a participant, technical errors or by any of the equipment or programming associated with or utilized in a giveaway, (iii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iv) unauthorized human intervention in any part of the entry process; (v) entries, prize claims or prize notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (vi) participants who have committed fraud or deception in entering or in a giveaway or claiming the Prize, (vii) an inability of the winner to accept the prize for any reason; (viii) an inability to fulfill or award a prize due to delays or interruptions due to Acts of God, natural disasters, pandemics/epidemics, terrorism, weather or any other similar event beyond Jetson’s reasonable control; or (xi) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in the sweepstakes or any promotion or prize related activities. If for any reason, a participant’s participation is erroneously deleted, lost, or otherwise destroyed or corrupted, participant’s sole remedy is another entry in the sweepstakes.
By entering the Sweepstakes each entrant agrees to release, discharge, and hold harmless the Jetson its legal representatives, affiliates, subsidiaries, agencies and their respective officers, directors, employees, and agents from any damages whatsoever suffered, sustained, or allegedly sustained in connection to the Sweepstakes or the acceptance of the Prize.
Acceptance of a prize also constitutes permission to Jetson to use winner's [name] [likeness], and [biographical information] for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.
Entrant understands and agrees that (s)he waives his/her right to sue or go to court to assert or defend his/her rights connected with participation in the sweepstakes. As a condition of participation, entrant and Jetson agree that any dispute, controversy, or claim arising out of or connected to the giveaway, including the determination of the scope or applicability of this arbitration provision, (each, a “Claim”) shall be resolved exclusively by binding arbitration under the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS.
ENTRANT AND JETSON ALSO AGREE THAT (A) ANY CLAIMS WILL BE RESOLVED INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS REPRESENTATIVE, MEMBER OF, OR OTHERWISE ON BEHALF OF OTHERS IN ANY PURPOSED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, AND NOT THROUGH ANY CLASS ACTION; (B) IF A CLAIM PROCEEDS IN COURT ANYWAY, BOTH SPONSOR AND ENTRANT WAIVE ANY RIGHT TO A JURY TRIAL; AND (C) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY), AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.
Jetson reserves the right to alter these terms and conditions at any time and in its sole discretion. Jetson reserves the right, at any time, to cancel, modify or suspend the Sweepstakes if, in its sole judgment, the Sweepstakes is not capable of being conducted as specified. These terms and conditions and any matters relating hereto shall be governed by and construed in accordance with the laws of New York and jurisdiction over any and all disputes shall be exclusive to the state and federal courts in New York, NY.

Jetson is not responsible for any entries not received for whatever reason.
